Ministry of Skin Online Store –Terms and Conditions

1. General

Before placing your order, please read through Ministry of Skin’s Terms and Conditions below. Your placement of an order shows your acceptance of these Terms and Conditions as well as Ministry of Skin’s Privacy Policy and Ministry of Skin’s websites Terms of Use, which may be updated by us from time to time without notice. If you are under 18 years of age, then you must obtain your parent or guardian’s consent before accessing and using the Ministry of Skin website.

3. Pricing

All prices are in Australian Dollars (AUD) and include GST.

All prices are correct at the time of publication. However, Ministry of Skin reserve the right to alter the prices for any reason.

Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the ‘Total Cost’.

Whilst Ministry of Skin try and ensure that all details, descriptions and prices which appear on this website are accurate, errors (including processing errors) may occur. If Ministry of Skin discover an error in the price or payment of any goods which you have ordered, Ministry of Skin will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If Ministry of Skin are unable to contact you, Ministry of Skin will treat the order as cancelled. If the order is cancelled and you have already paid for the goods, you will receive a full refund.

4. Availability

Ministry of Skin aims to provide accurate stock availability, however as stock numbers vary, the availability is only valid at the time shown. Unforeseen supply issues or unexpected demand may occasionally result in stock being unavailable. If this occurs you may cancel your order up until Ministry of Skin have received the stock from our suppliers. Please phone (03) 52 616 171 or email info@ministryofskin.com.au to make any changes.

5. Minimum Order

Value There is no minimum value for Ministry of Skin online orders.

6. Acceptance of Order

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order.

Unless otherwise provided for in these Terms and Conditions, you may not cancel or amend your order (including the delivery address, changes to colour or size, or removing items) after your order has been placed. Please ensure all details provided are full and correct at the time of order placement.

A contract between us for the purchase of the goods will not be formed until your payment has been approved by us and we have debited your credit or debit card.

Ministry of Skin reserves the right to restrict multiple quantities of an item, or restrict the number of items being shipped to any one customer or postal address. Ministry of Skin reserves the right to refuse to process or refuse service to anyone at any time at our sole discretion.

The sale contract is concluded in Victoria, Australia.

7. Payment

Full payment is required before order is dispatched or is made available for Click and Collect. Ministry of Skin accepts Visa, MasterCard, PayPal and Zip Pay. AMEX is not accepted.

The name on any credit card used for payment must match the name on the order. Other methods of payment, including cash, can be used for in-clinic orders, but not for orders placed through our website.

Any payment for an order must be cleared by Ministry of Skin before goods are dispatched. If your payment cannot be processed, your order will be rejected and you will be notified of this on the Ministry of Skin website. If a credit card payment cannot be processed you should contact your card issuer to try to resolve the problem, or use an alternative payment method in order to continue with your order.

In paying or attempting to pay for goods, you agree that you have not engaged in any fraudulent conduct or contravened any Law.

8. Security

Your credit card number will not be stored on the web site and will never be made publicly available. All information concerning your order is encrypted and can only be viewed by members of the Ministry of Skin team with authorised access to that information. As noted your credit card details are not visible to the members of our team.

9. Refund and Returns Policy

Products

Ministry of Skin Pty Ltd goods come with guarantees that are included under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and failure does not amount to a major failure. If the failure is minor, Ministry of Skin Pty Ltd reserve our right to offer to repair only. Ministry of Skin Pty Ltd reserve the right to not offer a refund or an exchange voucher.

When you change your mind

Ministry of Skin Pty Ltd are not required to provide a refund or replacement if you simply change your mind, found it cheaper somewhere else, decided you did not like the product or had no use for it. With the exception of RATIONALE skincare, please refer to the RATIONALE section.

Faulty Products

You are entitled to return a faulty item, as goods and services must be of acceptable quality.

An item is faulty if it:

  • does not do what it is normally supposed to do
  • is unacceptable in appearance or finish
  • isn’t durable

You are not entitled to return an item when:

  • Ministry of Skin Pty Ltd told you (or displayed a sign) about hidden defects before you bought it
  • you examined the item before buying and didn’t find defects you should have noticed
  • you used the item in an ‘abnormal’ way, or
  • you have used the item for a very long time

Ministry of Skin Pty Ltd may elect to return the product to the manufacturer/supplier to determine the nature of the problem. We reserve the right not to offer an exchange, refund or repair where the item fault is a result of misuse or neglect.

If a product is deemed faulty you will be offered a refund or repair. Instead of a refund, in some circumstances an exchange will be offered – but it is up to you if you choose to take a refund or exchange.

RATIONALE

The RATIONALE section of this policy is only applicable to RATIONALE formulations purchased directly from Ministry of Skin Pty Ltd in clinic or via www.ministryofskin.com.au. Purchases from another RATIONALE Medical Stockist, a RATIONALE flagship store or www.rationale.com must be returned or exchanged from the same location as the formulation(s) was originally purchased.

RATIONALE offers a 100 per cent money-back satisfaction guarantee as part of our RATIONALE return policy. You will have 30 days from date of purchase to return your RATIONALE order for a full refund or exchange. Proof of purchase must be provided when returning any formulation(s) (for more information see below ‘Proof of Purchase’ section.

Returned items will be refunded using the same method that was used to make payment. It may take Ministry of Skin Pty Ltd up to four business days to process the refund, and a further four business days for your financial institution to process the refund.

If exchanging items, if the cost of the replacement item is more than the item being returned, the customer is required to pay the difference. If the cost of the replacement item is less than the item being returned Ministry of Skin Pty Ltd will refund the difference. It may take Ministry of Skin Pty Ltd up to four business days to process the refund, and a further four business days for your financial institution to process the refund.

Ministry of Skin Pty Ltd may ask for feedback regarding the reason for returning or exchanging your order to assist us in tailoring your skincare ritual. However, you are under no obligation to provide feedback if the return or exchange is within the 30-day policy.

Any returns outside of the 30-day Return Policy will need to be approved by Ministry of Skin Pty Ltd and the RATIONALE Agency Team. You will be required to provide reasoning for the return or exchange request. Ministry of Skin Pty Ltd will endeavour to respond to your request to return a formulation out of the 30-day period within five business days.

Shipping costs incurred when ordering will not be eligible for any refund.

Please refer to sections ‘How to return a faulty product’ and ‘How to return or exchange (not faulty) RATIONALE formulation(s)’ for more information on how to return or exchange items.

Gift Vouchers

Gift vouchers cannot be returned if you change your mind. They also will not be exchanged for another denomination or named treatment or tender such as cash. Please note that Ministry of Skin Pty Ltd is not responsible for and is unable to replace gift cards which are lost or stolen.

Proof of Purchase

Returns, refunds, exchanges or repair requests must be accompanied by any one of the following proof of purchase documents to be processed:

  • Original receipt/invoice
  • Financial Statement (i.e. bank statement, credit card statement)
  • Copy or photograph of the receipt.

Sometimes you may need to provide more than one of these things to support your claim – for example, when a credit card statement does not clearly itemise the product.

How to return a faulty product
  1. Return with proof of purchase to Ministry of Skin’s clinic in Torquay – 160 Surf Coast Highway, Torquay, Victoria, 3228
  2. Email info@ministryofskin.com.au with your proof of purchase attached, faulty reason and we will endeavour to get back to you within two business days with instructions of how to return the item.
  3. Phone Ministry of Skin on (03) 52 616 171 to discuss the fault and we will provide instructions of how to return the item.

Faulty items will not incur an out-of-pocket shipping charge to return or receive replacement. However, if the item is deemed not faulty or is deemed not eligible to be returned, you will be required to pay for the shipping costs.

How to return or exchange (not faulty) RATIONALE formulation(s)

  2. Email info@ministryofskin.com.au with your proof of purchase attached and we will endeavour to get back to you within two business days with instructions of how to return/exchange the item.

Shipping fees to return/exchange a RATIONALE item for change of mind (see faulty product section for returning faulty products) are the responsibility of the customer including the cost of shipping to return item to 160 Surf Coast Highway, Torquay, Victoria, 3228 as well as the cost of shipping to send any replacement formulations to the customer.

Services

Ministry of Skin Pty Ltd services come with guarantees that are included under the Australian Consumer Law. If it doesn’t meet the guarantees that are included under the Australian Consumer Law, you are entitled to a remedy. The type of remedy depends on whether the problem is major or minor. A problem must be major or unable to be fixed before you can ask Ministry of Skin Pty Ltd for a refund.

This guarantee means Ministry of Skin Pty Ltd must:

  • use an acceptable level of skill or technical knowledge when providing the services, and
  • take all necessary care to avoid loss or damage when providing the services.
Major problems

It is a major problem if a service Ministry of Skin Pty Ltd provide is not done with due care and skill and:

  • a reasonable consumer would never have bought the service had they known beforehand about the problem, or
  • the service has not achieved what the service is normally supposed to do, and this problem cannot be fixed quickly or easily, or
  • the supply of the service has created an unsafe situation.

You can choose to:

  • cancel the contract and pay a reasonable amount for the work done, or seek a partial refund of money already paid, or
  • keep the contract and negotiate a reduced price for the drop in value of the service — this may mean asking for some money back if you have already paid.
Minor problems

If a problem is not major, Ministry of Skin Pty Ltd must be given a chance to fix the problem before you ask for a refund.

Ministry of Skin Pty Ltd may offer to:

  • redo the service at reduced cost
  • offer a fix to the problem by providing another service or product at reduced cost
  • contract another provider to resolve the problem using their services or products and cover the costs

10. Intended Use

By placing an order with Ministry of Skin you agree to use the products or services only for their intended purpose. If you use the products or services for any other purpose than their intended use, you will assume full responsibility for any loss or damage arising out of this use. 11. Shipping and Delivery

Please note delivery is only available within Australia. All items are shipped using Australia Post’s registered post and required a signature on delivery.

Delivery times are indicative only, and Ministry of Skin will not be liable for any failure to observe these delivery times.

It is the obligation of the customer to provide the correct delivery address details at the time of ordering. Should you enter the wrong address, Ministry of Skin are not obligated to re-send the order to the correct address at our expense. Ministry of Skin are unable to deliver to P.O. Boxes and Parcel Lockers, and orders addressed to either a PO Box or Parcel Locker will be automatically cancelled.

Once your product is packed and dispatched (this will happen at Ministry of Skin’s earliest convenience after Ministry of Skin receive your order within reasonable amount of working days), Ministry of Skin will send you an email, with a unique tracking code for you to track how far away your order is from your door. You can copy and paste the code on the Australia Post website.

Ministry of Skin want to ensure your parcel will arrive in great condition and securely so if you are not at home when your package arrives, Australia Post will leave a card which you just need to take to the nominated Australia Post branch and pick it up.

While Ministry of Skin do everything we can to ensure your order is delivered in a timely manner, Ministry of Skin will not be liable for any loss or damage incurred by any person as a result of delay caused by our carrier that we have no control over or by any event which is out of our reasonable control or foresight including but not limited to any delay caused by an incorrect delivery address being provided to Ministry of Skin.

Click and Collect:

Ministry of Skin’s free Click & Collect service is only available at our Torquay clinic – 160 Surf Coast Highway, Torquay, Victoria, 3228. Simply pick and pay for your product via the website and Ministry of Skin will send you an email as soon as it’s ready within a reasonable amount of working days.

Public Holidays:

Ministry of Skin does not ship or provide Click and Collect on Victorian and Australian Public Holidays.
